Terms of Service

Please read these Terms and Conditions (“Terms”) carefully before completing your booking. By purchasing our services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms.

These Terms are a binding agreement between you and Quest Excursions LLC, a California company (“Company,” “we,” “us,” or “our”), covering our travel and related services.

1. Booking and Payment Terms

1.1. Pricing and Fees
All prices are listed in U.S. Dollars (USD). Prices are subject to change without notice due to availability, supplier changes, currency fluctuations, or other circumstances. We reserve the right to correct errors in pricing at any time, even after booking. You are responsible for any foreign transaction fees charged by your payment provider.

1.2. Deposits and Final Payment
Some services require a non-refundable deposit at booking. Full payment must be made by the deadline provided at checkout. Failure to pay in full may result in cancellation without refund.

1.3. Taxes and Service Fees
All applicable taxes and service fees will be clearly displayed at checkout. Third-party service providers (such as airlines or hotels) may impose additional fees beyond our control.

2. Cancellations, Changes & Refund Policy

2.1. Customer Changes
Change requests must be submitted in writing. Changes are subject to availability and additional fees.

2.2. Customer Cancellations
All cancellations must be made in writing. Refund eligibility depends on the service booked. Certain bookings are non-refundable or may incur cancellation fees.

2.3. Changes and Cancellations by Company
We reserve the right to modify or cancel services due to external factors beyond our control. If this occurs, we will offer alternatives or travel credits at our discretion.

3. Assumption of Risk and Waiver of Liability

3.1. Acknowledgment of Risk
Travel inherently involves risks, including but not limited to: personal injury, illness, property loss, natural disasters, pandemics, transportation delays, or acts of terrorism. By booking, you voluntarily assume all risks.

3.2. Waiver and Release of Liability
To the fullest extent permitted by law, you release and hold harmless Quest Excursions LLC, its owners, employees, agents, and affiliates from any claims, liabilities, or expenses arising from your travel, whether due to negligence or otherwise.

3.3. Third-Party Providers
We are not liable for actions, errors, or omissions of any third-party service providers, including transportation, lodging, or activities. We act solely as an intermediary between you and third-party service providers, including but not limited to airlines, hotels, tour operators, and local transport companies. We are not responsible for any acts, omissions, or negligence of these providers, including delays, overbooking, or service failures.

4. Customer Responsibilities

4.1. Travel Documents
You are solely responsible for obtaining and carrying valid identification, visas, permits, and other necessary documents. Some countries require that your passport be valid for at least six (6) months beyond your intended date of departure. Visa requirements vary by country and nationality.

4.2. Travel Insurance
We strongly recommend purchasing comprehensive travel insurance to protect against unforeseen events.

4.3. Health and Safety Compliance
You certify that you are physically fit for travel and will comply with health and safety protocols required by providers. You are responsible for obtaining any required vaccinations, medications, and medical clearances before traveling. Health regulations, including COVID-19 testing and vaccination requirements, are determined by each country and may change without notice.

4.4. Conduct
You agree to behave respectfully and safely throughout your travels. Misconduct may result in removal from activities without refund. It is your responsibility to familiarize yourself with the local laws, customs, and regulations of your destination(s). We are not liable for any legal issues you encounter in the U.S. and while abroad.

5. Media Release

By participating in our services, you grant Quest Excursions LLC the irrevocable right to use photographs, videos, and recordings of you taken during trips for promotional, commercial, or editorial purposes, without compensation. If you do not consent, please notify us in writing prior to your trip.

6. COVID-19 and Public Health Disclaimer

You acknowledge the contagious nature of COVID-19 and other public health risks. By traveling with us, you voluntarily assume all related risks. You agree to comply with all health protocols, including testing, vaccination, and quarantine measures as required by law or service providers. We are not responsible for delays, quarantines, cancellations, or expenses due to health-related disruptions.

7. Limitation of Liability

To the fullest extent permitted by law, Quest Excursions LLC is not liable for indirect, incidental, special, or consequential damages arising from your travel, including lost profits, data loss, or goodwill.

8. Dispute Resolution & Governing Law

8.1. Governing Law
These Terms are governed by the laws of the State of California.

8.2. Dispute Resolution
Any dispute will first be addressed through good-faith negotiation. If unresolved, disputes will be submitted to binding arbitration in Contra Costa County, California under the rules of the American Arbitration Association.

9. Miscellaneous

9.1. Warranty Disclaimer
Quest Excursions, nor any of its subsidiaries, officers, directors, employees, stockholders, or affiliates, makes any warranty of any kind, whether expressed or implied, for any goods or services provided under these Terms of Service, including any warranty of merchantability, fitness for a particular purpose or non-infringement. In the event that some of the aforementioned warranties may not be disclaimed as a matter of law, the scope and duration of such warranties will be the minimum required under applicable laws.

9.2. Confidentiality
Quest Excursions materials, websites, registration system, proposals, pricing information, sample itineraries, final Trip Itineraries, contract for services and all other documents or information provided by Quest Excursions are exclusive property of Quest Excursions and may not be divulged, redistributed or reproduced without expressed written consent by Quest Excursions.

9.3. Intellectual Property
All indicia, including but not limited to names, logos, marks, emblems and designs, associated with or identifying Quest Excursions are owned and legally protected by Quest Excursions and may not be used without Quest Excursions’ prior written consent.

9.4 Amendments
We reserve the right to update these Terms at any time. Updates are effective immediately upon posting.

9.5. Severability
If any term is found unenforceable, the remainder remains in effect.

9.6. Entire Agreement
These Terms constitute the entire agreement between you and us, superseding prior agreements.

By completing your purchase, you confirm that you have read, understood, and agree to these Terms and Conditions.
